Please read this Privacy Policy carefully before using this Site.

Our Commitment to Privacy. FUJIFILM Recording Media U.S.A., Inc. (“we”, “us” or “Fujifilm”) cares about your privacy. This Privacy Policy will help you better understand the online information practices that apply when you visit the FUJIFILM Dternity website at www.dternity.net (the “Site”) and the choices you can make about the way your personally identifiable information is collected and used.

Consent. By accessing, browsing or otherwise using this Site, you consent to the collection, use, storage and disclosure of personal information as described in this Privacy Policy and the Terms of Use linked to the Site. The Terms of Use are an integral part of this Privacy Policy and are hereby incorporated by reference into this Privacy Statement.

Scope. This Privacy Policy applies to personally identifiable information about individuals collected through the Site and does not apply to the information collected, used or disclosed with respect to corporate or commercial entities. This Privacy Policy does not impose any limits on our collection, use, storage or disclosure of information exempted under applicable privacy legislation, including business contact information and certain publicly available information.

Information We Collect. Information that we collect, use, store or disclose falls into two broad categories: (1) information you voluntarily provide to us while on our Site and (2) information that is automatically collected through the Site.

Information you voluntarily provide to us. While Fujifilm does not require that you provide personally identifiable information to visit the Site, we may collect, use and store personally identifiable information you voluntarily provide to us while on the Site. For example:

When you request a newsletter, product information or a product brochure, or correspond with us via the Contact Us page of the Site, you will be required to provide certain personally identifiable information, including your first and last name, company name, email address, telephone number, and other information. Fujifilm may use such information to communicate with you in response to your requests.

From time to time, you may enter a sweepstakes or contest through the Site or otherwise through an e-mail communication by virtue of your having created an account with Fujifilm. Participation in sweepstakes and contests is completely voluntary. If you choose to participate, we may ask you for your name, mailing address including zip code, date of birth and e-mail address so that we can administer the sweepstakes or contest, notify winners and award prizes.

When accessing our Partner Login page, Fujifilm authorized resellers may be required to provide a user name and password that we use to authenticate a reseller’s identity. We may use your personally identifiable information to send you information regarding upcoming events, end user promotions, announcements regarding new or existing products, services or benefits provided by Fujifilm or its affiliates, market research communication (including customer surveys) or that is otherwise intended to promote FUJIFILM products. If at any time you would like to stop receiving such information from Fujifilm, please notify us as provided in the “Contact Us” section below.

We may also use personally identifiable information held about you as follows:

  • To improve Site performance and/or otherwise ensure that content on our Site is presented in the most effective manner for you and for your computer;
  • To help us understand your needs and interests and provide you with better products and services;
  • To provide customer service and support;
  • To monitor your compliance with the Terms of Use;
  • To allow you to participate in interactive features of our Site, when you choose to do so;
  • To notify you regarding changes to this Privacy Policy or the Site;
  • For our risk management purposes;
  • To manage or transfer our assets or liabilities, for example in the case of an acquisition, disposition or merger;
  • To protect us, you and others from fraud and error and to safeguard our business interests; and
  • To comply with legal and regulatory requirements;

Information you voluntarily provide to us through the Site may be combined with information you provide to us through other sources.

Public Content Posted through the Site. For purposes of this Privacy Statement, "publicly accessible areas" of our Site are those accessible by the general public or other registered users through the Social Media section of the Site. Notwithstanding any other statement in this Privacy Statement, you acknowledge that you are solely responsible for any personally identifiable information that you choose to disclose and make publicly accessible on social media websites (including LinkedIn, Twitter and Facebook) accessed through the Site and that under no circumstances will Fujifilm be liable in any way for the disclosure and public accessibility of such personally identifiable information. You acknowledge that any personally identifiable information (or any other content), including any reviews or comments, posted to publicly accessible areas may remain publicly accessible indefinitely.

Information Collected Automatically. We also collect, use and store certain non-personal information that is generated automatically as you navigate through the Site, which may include your Internet Protocol address, browser and operating system descriptor, URL of referring webpage, preferences, likes and dislikes, and other information. Such information is collected for reporting about our Site usability, performance and effectiveness, and to improve customer experience, usability and Site content. For more information, see the “Use of Cookies” section below.

Use of Cookies. Like many other companies, we may use a standard feature found in browser software called a "cookie" that enables us to place bits of text on your hard drive for record-keeping purposes. By showing how and when visitors use our Site, cookies help us track user trends and patterns. They also relieve you from having to re-enter your preferences on certain areas of the Site where you have previously entered preference information. We may also use web beacons (also known as "single-pixel GIFs") to access cookies and to count users who visit our Site or open email messages. We may collect information about your computer’s connection to the Internet to allow us, among other things, to improve the delivery of our web pages to you and to measure traffic on the Site. We may sometimes use the non-identifying and aggregate information that is collected as described above to enhance the design of our Site and help us understand the needs of our visitors. By changing the settings on your Internet browser, you may be able to disable cookies or to set a warning on your computer screen before cookies are issued. However, please note that while refusing to accept cookies should not render the Site unusable, certain parts or features of the Site may not be available if the use of cookies is disabled.

With Whom We Share Information. Except where restricted by applicable law, Fujifilm may, from time to time, share your personally identifiable information with its affiliated companies, professional advisors, government agencies and/or third party subcontractors, strategic partners, suppliers and service providers (such as website hosting companies, e-mail service providers, analytics companies, fulfillment companies, customer service and technical support service providers and other service providers that use such information on our behalf) to the extent necessary to fulfill a specific purpose. In addition, we may disclose your personally identifiable information, with or without your consent, in the event of any corporate reorganization, merger or acquisition effecting Fujifilm’s or its affiliates’ business or assets, to enforce our Terms of Use or other agreements, or when we are required to do so (i) under applicable law or in connection with any legal proceeding, subpoena or court order; (ii) to prevent physical harm or property damage; (iii) as part of an investigation of suspected or actual unlawful conduct; (iv) to respond to claims that any Content (as defined in the Terms of Use) violates the rights of third-parties, including but not limited to, intellectual property and privacy rights; (v) to respond to your requests for customer service or technical support; or (vi) to protect the rights, property, or safety of Fujifilm, our customers, or others, or to protect the personal safety of Fujifilm employees, users of its websites, or the public. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction.

Data Security. To protect your personally identifiable information against unauthorized acquisition, access, use and disclosure, maintain data accuracy, and ensure the correct use of information, we utilize reasonable technical, administrative and physical measures to safeguard and secure personally identifiable information collected through the Site. Unfortunately, the transmission of information via the Internet is not completely secure. Despite our reasonable efforts, we cannot guarantee the security of your personally identifiable data transmitted to our Site; any transmission is at your own risk. Accordingly, we disclaim any liability for any theft or loss of, unauthorized access or damage to, or interception of any data or communication by using this Site.

If you create an account with us containing your personally identifiable information protected by a password, you are responsible for keeping your password confidential. We strongly recommend that you do not give your password to anyone. We also recommend that you change or re-arrange your password every three months. If you are using a public computer (for example, at a library), or if it is a shared computer, we urge you to log out of your account and our Site altogether, and quit the browser application before you leave the computer. This may help to prevent others from accessing your account information.

All information you provide to us is stored on secure servers located in the United States.

Links to Third Party Websites. The Site may contain links to third party websites that are not under the control of or maintained by Fujifilm and Fujifilm is not responsible for the content, security, privacy policies or the operation of third party websites. Further, if you opt to engage in transactions on third party websites linked to the Site, such as purchases or promotions, we are not responsible or liable for any issues arising from or related to such transactions and you must deal with the third party operators of such websites if any issues arise. When visiting any third party website we suggest that you routinely review the applicable privacy policy or statement and other posted terms and conditions to understand your rights and options. The inclusion of any link to a third party website on the Site does not imply endorsement by Fujifilm of such third party website or any association with its operators.

Access. Upon written request and authentication of identity, we will provide you with any personally identifiable information under our control, information about the ways in which that information is being used and a description of the individuals and organizations to whom your information has been disclosed. We will make the information available within 30 days or provide written notice where additional time is required to fulfill the request.

In some situations we may not be able to provide access to certain personal information. This may be the case where, for example, disclosure would reveal personal information about another individual, the personal information is protected by attorney/client privilege, the information was collected for the purpose of an investigation or where disclosure of the information would reveal confidential commercial information that, if disclosed, could harm our competitive position. We may also be prevented by law from providing access to certain personal information.

Where an access request is refused, we will notify you in writing, document the reasons for refusal and outline further steps which are available to you.

Corrections. We rely on you to ensure that information which you provide to us through the Site is current, complete and accurate. We will make a reasonable effort to ensure that personal information we use or disclose about you is accurate and complete based on the information provided. We recognize that there may be times when you want to access your account to modify your personally identifiable information. Accordingly, we invite you to contact us, as provided in the “Contact Us” section below.

Our Commitment to Children’s Privacy. Protecting the privacy of children is important to us. For that reason, we do not collect information from or maintain information on our Site from users who we know to be under the age of 13 and no sections of our Site are structured to attract or solicit any person under this age. In addition, our Terms of Use prohibit Site membership by individuals under the age of 13. We encourage parents and legal guardians to take an active role in monitoring their child’s online activities.

Do Not Track. "Do Not Track" is a privacy preference that you can set in your Internet browser that sends a signal to a website that you do not want the website operator to track certain browsing information about you. However, because our Site is not configured to detect Do Not Track signals from a user’s computer, we are unable to respond to Do Not Track requests at this time.

Changes to this Privacy Policy. Fujifilm reserves the right to change, amend, or update this Privacy Policy from time to time. Changes to our Privacy Policy will be posted to this Site and, where appropriate, notified to you by e-mail. On return visits to the Site, please remember to review the Privacy Policy for any changes, since continued use of our Site after any posted revision indicates your consent to our use of your information in accordance with the changed, amended, or updated Privacy Policy, whether or not you have received notification of the change, amendment or update. Revisions to our Privacy Policy will not affect information collected prior to such revisions.
